Terms of Service for MemePilot

1. Acceptance of Terms

By downloading, installing, accessing, or using the MemePilot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. App Usage and Features

MemePilot allows users to generate memes by providing text ideas, selecting topics, and utilizing AI-powered image generation and punchline creation features. You agree to:

• Use the App for lawful and creative purposes only.
• Not use the App to create, share, or promote content that is illegal, harmful, offensive, defamatory, obscene, infringing, or otherwise objectionable.
• Not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Not interfere with or disrupt the App's functionality, servers, or networks connected to the App.
• Comply with all applicable local, state, national, and international laws and regulations in your use of the App.

3. User-Generated Content and AI

You are solely responsible for the text, ideas, and images you input into the App ("User Content").

• You retain ownership of your User Content.
• By using the App, you grant MemePilot a temporary, non-exclusive, royalty-free license to use, reproduce, and modify your User Content solely for the purpose of providing the App's services to you (e.g., sending it to third-party AI services for processing).
• The App utilizes third-party AI services (e.g., OpenAI, Replicate) to generate images and text. The output from these AI services ("AI-Generated Content") is provided to you through the App. Your rights to use AI-Generated Content may be subject to the terms of those third-party services.
• MemePilot does not claim ownership over AI-Generated Content.
• You acknowledge that AI-Generated Content may sometimes be unexpected, inaccurate, or not perfectly aligned with your input.

4. Intellectual Property

The App, including its design, graphics, user interface, features, and underlying technology (excluding User Content and AI-Generated Content attributed to third parties), is the property of MemePilot and its licensors and is protected by copyright, trademark, and other intellectual property laws.

5. Third-Party Services

The App integrates with third-party services such as Supabase, OpenAI, and Replicate to provide its functionalities. Your use of these third-party services through the App is subject to their respective terms of service and privacy policies. MemePilot is not responsible for the practices or content of these third-party services.

6. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MEMEPILOT DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOU ACKNOWLEDGE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEMEPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. Subscription and Billing

MemePilot may offer premium features through auto-renewable subscriptions ("MemePilot Premium"):

• Subscription Title: MemePilot Premium
• Subscription Length: Available in monthly and annual terms
• Pricing: Subscription prices are displayed in the app and charged to your Apple ID account
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase
• Account Management: You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase
• Cancellation: You may cancel your subscription at any time, but no refunds will be provided for unused portions of the subscription period
• Price Changes: We reserve the right to change subscription prices with advance notice

By purchasing a subscription, you agree to pay all applicable fees and taxes. All sales are final.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
