Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the MemoryRevive application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

MemoryRevive is a photo restoration and animation application that uses advanced AI technology to:

• Enhance, restore, colorize, and improve old or damaged photographs
• Animate photos with emotional expressions and movements
• Apply various restoration options including face enhancement, scratch removal, and color correction
• Create animated memories with 10 different emotional modes

The App offers both subscription-based and one-time purchase options with a dual credit system.

3. Credit System

MemoryRevive operates on a dual credit system:

• Membership Credits: Provided monthly with active subscriptions. These credits reset each billing cycle and cannot be carried over.
• Permanent Credits: Purchased as one-time credit packs or earned as bonuses. These credits never expire and are used after membership credits are depleted.

Credits are consumed when using restoration or animation features. The specific credit cost depends on the complexity of the operation.

4. Subscription Plans & Pricing

MemoryRevive offers the following auto-renewable subscriptions:

• Plus Monthly: 20 membership credits per month
• Pro Monthly: 40 membership credits per month
• Pro Yearly: 40 membership credits per month + 60 permanent credits bonus on first purchase

One-Time Credit Packs:

• 5 permanent credits
• 20 permanent credits
• 50 permanent credits

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and turn off auto-renewal in your Apple ID account settings.

5. Credit Refund Policy

If a restoration or animation operation fails due to service unavailability, server timeout, or technical errors, consumed credits will be automatically refunded to your account. This does not apply to operations that complete successfully but do not meet your aesthetic expectations.

6. Service Limitations

Due to high server load or technical issues, operations may occasionally timeout or fail. While we strive for 99% uptime, we cannot guarantee uninterrupted service. In such cases, credits are automatically refunded as per Section 5.

7. Free Trial

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

8. Purchase Refund Policy

All subscription and credit pack purchases are final and non-refundable, except as required by applicable law. Refund requests for App Store purchases should be submitted through Apple's standard refund process. Credit refunds for failed operations (Section 5) are handled automatically within the App.

9. User Content & Intellectual Property

You retain all rights to the photos you upload to the App. By using our restoration and animation services, you grant us a limited, temporary license to process and modify your images solely for the purpose of providing the service. Processed images and animations are not stored on our servers after delivery to your device.

10. Prohibited Uses

You agree not to:

• Use the App for any illegal purposes or to violate any laws in your jurisdiction
• Upload images that violate intellectual property rights, privacy rights, or contain illegal content
• Attempt to reverse engineer, decompile, or extract the AI models used by the App
• Use automated systems or bots to abuse the credit system

11. Third-Party Services

The App uses third-party AI services (including but not limited to Replicate and fal.ai) for photo processing and animation. By using the App, you acknowledge that your images will be temporarily processed through these services in accordance with their respective privacy policies and terms of service.

12. Limitation of Liability

To the maximum extent permitted by law, MemoryRevive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the service
• Quality of restored or animated images not meeting expectations

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified terms.

14. Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms of Use or engage in fraudulent activity.
